| Summary of the case |
In October 2002, a United Nations Panel of Experts accused 85 OECD-based companies of violating the Guidelines for their direct or indirect roles in the illegal exploitation of natural resources in the Democratic Republic of Congo (DRC). Tremalt Ltd was cited by the Panel, because of its for its cobalt/copper exploitation activities. Tremalt Ltd/Kababankola Mining Company are part of the Breco Business Group owned by John Bredenkamp. The Panel alleged that the price Tremalt paid for the mining concessions in Katanga was too low.In addition, there was a confidential profit sharing agreement between Tremalt and the governments of DRC and Zimbabwe.
The involvement of high-ranking officers from the Zimbabwean Defence Forces (ZDF) suggests that there may also have been improper political involvement. Tremalt and other Breco Business Group companies, Raceview Enterprises and Aviation Consultancy Service Company (ACS) were allegedly involved in procuring equipment for the ZDF (Zimbabwean Defense Forces) and the Congolese Armed Forces, which enabled them to prosecute the war.
It is alleged that Bredenkamp’s representatives supplied spare parts for ZDF Hawk jets, which even if it were not formally in breach of the European Union sanctions on Zimbabwe, would appear to be incompatible with the human rights provision of the Guidelines.

The cases against Tremalt has been blocked by the UK NCP. The UK NCP claimed the case was resolved by the UN Panel and could not be reopened. Due to the NCP’s inaction, RAID withdrew the complaint. |
