Summary of the case On 26 November 2020, complainants Korean Civil Society in Solidarity with Rohingya, Korean Transnational Corporations Watch, and Justice For Myanmar filed five complaints with the South Korean NCP. The complaints were also filed with the National Human Rights Commission of Korea and the UN Working Group on Business and Human Rights. The complaints allege that five South Korean multinational corporations have commercial ties with the Myanmar military, thereby contributing to the international crimes of genocide, war crimes, and crimes against humanity. The businesses are:
-POSCO, Pan-Pacific, and Inno Group, which operate steel and apparel joint ventures with and/or lease land held by the Myanmar military-owned conglomerate Myanmar Economic Holdings Limited (MEHL);
-LOTTE Corporation, whose subsidiary LOTTE Hotels and Resorts has developed a hotel in Yangon on land leased from the Myanmar military; and
- Daesun Shipbuilding & Engineering Co. Ltd., majority-owned by the Korean Eximbank, which transferred a Landing Platform Dock (LPD) warship to the Myanmar Navy in December 2019. The LPD, now the biggest ship in Myanmar’s navy, significantly upgrades Myanmar’s naval capabilities to transport troops and equipment such as armored personnel carriers and helicopters. The complainants assert the transfer may cause South Korea to breach its obligations under the Arms Trade Treaty.

The complainants assert the companies have breached the OECD Guidelines by failing to conduct human rights due diligence to prevent, mitigate and remediate abuses when they occur. The complainants request intervention by the Korean NCP to urge the businesses in question to fulfil their international human rights obligations, including cutting all ties with the Myanmar military and military-owned businesses.
