Résumé de la plainte On 22 December 2020 the Uwema Aminigboko Community from the Abua/Odual Local Government Area of Rivers State, Nigeria, filed a specific instance against Deawoo Nigeria Ltd. The complaint concerns activities of Daewoo Nigeria Ltd. in establishing a fabrication yard and related infrastructure for an oil and gas development project (Shell Enwhe Field Development Project - Gbaran Phase 3 of OML 22). The complainants allege that Daewoo violated the OECD Guidelines and Nigerian domestic laws when it forcefully occupied the land of the Akiro family for use as a fabrication yard, and mobilized earth moving machines to forcefully commence the construction of Enwhe East Manifold in the land of the Ogbolo Family. Daewoo also did not fulfill a quota to recruit a third of its workforce from local indigenous unskilled, semi-skilled, and skilled professionals, but instead imposed external third party workers on the community. Daewoo has allegedly also improperly discharged waste effluent onto the community's lands. The complainants assert that Daewoo operated with support of heavily armed security forces and declined to engage or consult with the Chief/Head of the landowning families, the Aminigboko Community Education and Employment Bureau and Community Development Committee, or other relevant public affairs officers. The complainants assert that Daewoo Nigeria Ltd. began operations in February 2019 and until the date of filing of this complaint has not engaged in any meaningful consultation with the community to obtain consent for its operations. The complainants are seeking mediation from the Korea NCP to facilitate dialogue and help resolve the ongoing crisis.
Développements/Résultat On 28 December 2020, the Korean NCP acknolwedged receipt of the complaint and requested that it be filed again using a particular format, which the complainants did on 5 January 2021.
