Issue Belgian companies illegal resource exploitation in DRC
Summary of the case In October 2002, a United Nations Panel of Experts accused 85 OECD-based companies of violating the Guidelines for their direct or indirect roles in the illegal exploitation of natural resources in the Democratic Republic of Congo (DRC). In November, 2004, a group of Belgian NGOs filed a complaint against Cogecom and 3 other Belgian companies concerning the illegal exploitation of natural resources in the DRC. Cogecom is cited by the Panel for its involvement in the coltan trade. The Panel alleged that Cogecom imported coltan and cassiterites from the DRC into Belgium via Rwanda, directly participating in the financing of the rebel movement of RCD-Goma. The Belgian Senate stated that an analysis of the transactions and movements of capital appear to confirm the direct participation of Cogecom in the financing of the rebel movement of RCD-Goma.

Developments/Outcome The case was rejected due to the existence of ongoing legal procedures. The complainants note that the NCP’s decision was never formally communicated. They learned about the NCP’s decision in the OECD’s annual report in 2005.
